Level Up Employee and Contractor Engagement Training Program

Official Rules

VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD BE REQUIRED.

 

  1. Eligibility: The Level Up Employee and Contractor Engagement Training Program (the “Program”) is open only to individuals who are 18 years of age (or the age of majority in their jurisdiction of residence, whichever is older) or older at the time of entry and who are either, as of the date of entry, (i) an employee of Otis or (ii) an employee of an Active Contractor of Otis. The Program is subject to all applicable laws and regulations. An “Entrant” is an eligible person who submits an entry in accordance with these Official Rules. An “Active Contractor” is defined as a third-party independent contractor under a current and effective written service agreement with Otis which is in effect at any time during the Program Period, who is not in default and is in good standing. An “Entry” is properly completing and submitting an Entrant’s registration at the Program Website described below.
  2. Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Otis, as final and binding as it relates to the Program. The Program is subject to all applicable federal, state and local laws.
  3. Intent of the Program: The intent of the Program is to train employees of Otis and Otis’s Active Contractors in environmental, health and safety matters, and to encourage such employees to continue to study and learn about environmental, health and safety matters.
  4. How to Enter: You may enter the Program by signing into the Program page located at www.otis-levelup.com (“Program Website”), registering an account with all information requested (i.e. name, email address, country of residency, Otis branch, etc.); and taking the quizzes which are posted from time to time during the Program Period and which are intended to test your knowledge of the cardinal rules of safety and stop work authority. Entrants who do not complete the registration or who do not comply with these Official Rules will be disqualified at Otis’s sole discretion. You may not enter or create more accounts or register more than one time by using multiple email addresses, telephone numbers, identities, IP addresses, use of proxy servers, other devices or any other method of unauthorized entry in an attempt to circumvent the rules, all in Otis’s sole and absolute discretion, and all of your entries will be declared null and void. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at Otis’s sole discretion.
  5. High scores: Quizzes will be posted on the Program Website at www.otislevelup.com. Each quiz shall consist of several questions. Each question shall be assigned a point value, which will be reflected in the Program. Entrants will receive points for answering questions correctly. The names of top-scoring Entrants will be posted on a leaderboard on the Otis EH&S intranet page and may be shared with the broader Otis community.
  6. Terms: Otis reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Program should (in its sole discretion) a virus, bugs, non-authorized human intervention, Acts of God, pandemic, epidemic, “shelter in place” and similar orders and other government actions, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Program. In such case, Otis may determine select the top scoring Entrants from all eligible entries received prior to and/or after (if appropriate) such event. Otis reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Program or website or violates these Official Rules.
  7. Otis has the right, in its sole discretion, to maintain the integrity of the Program, to void Entries for any reason, including, but not limited to; multiple Entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Program rules; or the use of bots, macros or scripts or other technical means for entering.
  8. Any attempt by an Entrant to deliberately damage any web site or undermine the legitimate operation of the Program may be a violation of criminal and civil laws and should such an attempt be made, Otis reserves the right to seek damages from any such person to the fullest extent permitted by law.
  9. Limitation of Liability: By entering you agree to release and hold harmless Otis Elevator Company and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such Entrant’s participation in the Program, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the Entry process; or (v) electronic or human error which may occur in the administration of or the processing of entries.
  10. Disputes: THIS TRAINING PROGRAM IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF CONNECTICUT AND, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Program, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Program shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Connecticut, having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Program), and participant further waives all rights to have damages multiplied or increased.
  11. Privacy Policy: Information submitted with an Entry or quiz is subject to the Privacy Policy stated on Otis’s Web Site. By participating in the Program, eligible Entrant hereby consents to Otis’s or authorized agents’ collection, use, and disclosure of Entrants’ personal information for the purposes of administering the Program and identifying top-scoring Entrants. Entrant acknowledges that he/she has read, understood and accepted the Privacy Policy stated on Otis’s Web Site, which provides more information about Otis’s privacy practices and is located at https://www.otis.com/corporate/privacy-policy/.
  12. By participating in the Program, each Entrant hereby consents to Otis’s or authorized agents’ collection, use, and disclosure of Entrants’ personal information for the purposes of administering the Program and identifying top-scoring entrants. Each Entrant acknowledges that he/she has read, understood and accepted the Otis’s privacy statement, which provides more information about Otis’s privacy practices.
  13. Sponsor: The Sponsor of the Program is Otis Elevator Company located at 1690 New Britain Avenue, Farmington, CT 06032, USA.
